Pet fees and pet rent in Illinois

HB 3564 does not cap or ban pet fees or pet rent. It treats them like any other fee a tenant must pay: disclose them on page one of the lease and in the listing.

Updated November 1, 2026 · Based on Public Act 104-0479

Three kinds of pet charges

ChargeState lawWatch out for
Non-refundable pet feeAllowed, disclose on page oneCall it non-refundable so it is not treated as a deposit
Monthly pet rentAllowed, disclose on page oneInclude it in the monthly cost for tenants with pets
Refundable pet depositAllowed, disclose on page oneCounts as part of the security deposit under Chicago and Cook County rules

Are pet fees "required"?

A pet fee only applies to tenants with pets, but for those tenants it is not optional. List it on page one with the condition, for example "Pet rent: $35 per month per pet, only if you have a pet." Your fee page has a note field for exactly this.

Assistance animals

Service animals and emotional support animals are not pets under fair housing law. Do not charge pet fees, pet rent or pet deposits for them, whatever the lease calls them.

Proposed caps

Separate bills have proposed capping pet fees and pet rent statewide. They are not part of HB 3564. Check the current status before relying on a cap or its absence.

Make your disclosure in about two minutes. List pet fees with a clear "only with a pet" note, so renters with pets see the real monthly cost.
